Introduction

These Terms & Conditions (“T&Cs”) govern all bookings, purchases, and interactions between Experience My India (“Company,” “we,” “our”) and the person or organization making a booking or using our services (“Client,” “you,” “your”).

By making a booking, paying any amount, or using our services, you agree to be bound by these T&Cs in full. These terms are intended to protect both you and our company, ensuring transparency, fairness, and clarity in all dealings.

1. Interpretation — Key Definitions

  • Booking: Any reservation for travel, accommodation, transport, tour, activity, or service made directly with us or through authorised agents.
  • Services: Travel-related services provided or arranged by us, including packages, transportation, hotels, guides, etc.
  • Supplier: Any third-party provider such as a hotel, airline, cab operator, or guide who delivers part or all of the services.
  • Package: A combination of two or more travel services sold together at an inclusive price.
  • No-show: Failure by a Client to appear at the scheduled location or time without prior written cancellation.

2. Applicability and Scope

These Terms apply to all bookings made with Experience My India, whether online, by phone, or through authorized agents.
A booking becomes legally binding only when confirmed in writing or by email after payment or deposit is received.

3. Booking Process & Contract Formation

To make a booking, you must provide accurate traveller information and pay the required amount. We may require Aadhaar or Passport details, age, and other particulars for confirmation.
We reserve the right to decline or cancel any booking if inaccurate or incomplete information is provided.
By confirming a booking, you agree that you are authorized to represent all persons listed on the booking.

4. Prices, Taxes & Surcharges

All prices are quoted in Indian Rupees (INR) and include applicable taxes as displayed.
They exclude optional expenses, local levies, or extra charges not specifically mentioned in your quotation.
Prices may change before confirmation due to revisions by suppliers, fuel prices, or government taxes. Once confirmed, your price is fixed as per the issued invoice.

5. Payment Terms

Advance payment in full is required unless specific instalments are approved and documented in writing by the sales agent.

The remaining balance must be cleared at the time of journey start or hotel check-in to ensure a seamless experience.

Failure to make timely payments may result in automatic cancellation of the tour without refund.

6. Amendments by You (Client)

All amendment requests must be made in writing.
We will try to accommodate reasonable requests based on availability.
An administrative amendment fee and supplier charges (if any) will apply.
Some services, such as non-refundable flight or hotel bookings, cannot be changed or transferred once confirmed.

7. Cancellations by You

Cancellations must be notified in writing by the person who made the booking.
The effective date is the date we receive your written notice.

Cancellation charges (as a percentage of total tour cost):

  • More than 30 days: Complete refund of  deposit minus administrative fee
  • 15–30 days: 30%
  • 7–14 days: 50%
  • 0–7 days or No-show: 100%

Refunds, if applicable, will be processed after deducting non-refundable supplier costs.
No refund is possible in case of Monument Ticket Bookings/ Darshan Passes Bookings and  in case of competitive pricing.
Third party vendors may have their specific cancellation and refund policy.
In case of Train Bookings/ Flight Bookings/ Bus Bookings made through us, refund shall be processed after following the respective supplier cancellation and refund policy. 

8. Cancellations & Changes by Experience My India

We reserve the right to cancel or modify a confirmed booking for genuine reasons such as weather disruptions, supplier issues, or operational limitations.

As an act of goodwill, Experience My India does not issue refunds for cancellations made by us due to unavoidable circumstances.
However, the full amount paid will be held as an advance credit for future travel booked within one (1) year from the cancellation date.

Clients rebooking within this period will be eligible for exclusive discounts on new quotations, subject to prevailing travel costs and availability.
No additional compensation shall be payable in such cases.

9. Force Majeure / Unavoidable & Extraordinary Circumstances

Experience My India shall not be liable for delays, omissions, or changes in itinerary caused by events beyond our control including (but not limited to):
war, civil unrest, political instability, natural disasters, pandemics, strikes, road closures, weather conditions, or supplier defaults.

We will also not be liable for any missed sightseeing if caused by:

  • Traffic jams
  • Road diversions or local restrictions
  • Guests spending extended time at one location resulting in time shortage

Within the available time, our team will always try to cover the maximum sightseeing points possible.

Experience My India does not provide or arrange travel insurance or monetary coverage of any kind. Clients are solely responsible for arranging their own insurance if desired.

10. Suppliers and Your Contract with Suppliers

In many cases, we act as an intermediary between you and third-party suppliers (hotels, transport, etc.).
The supplier’s own terms apply in addition to ours.
We are not liable for actions or omissions of suppliers, though we select them with care.

11. Travel Documents, Passports, Visas & Formalities

It is mandatory for all travellers to provide identification before travel:

  • Indian Nationals: Aadhaar Card (front and back)
  • Foreign Nationals / NRIs: Passport (and visa where applicable)

It is the client’s responsibility to ensure the validity and accuracy of all documents.
We are not responsible for travel denial, delays, or penalties due to missing or invalid documents.

Failure to provide proper documents may lead to booking cancellation as per client-cancellation policy.

12. Health, Fitness & Insurance

Clients must inform us of any medical conditions, disabilities, or special needs before booking.
We are not liable for medical emergencies, illnesses, or pre-existing conditions.
Adequate travel insurance is recommended but must be arranged by the traveller directly.

13. Limitation of Liability

Experience My India, its employees, and representatives shall not be held liable for any accident, injury, loss, or death occurring during any part of the tour or due to the actions of third-party suppliers.

In such unfortunate events, our responsibility is limited to the refund of unutilised services, after deducting the cost of services already availed.

We may assist with local coordination but are not financially responsible for damages, compensation, or claims beyond this limit.

14. Insolvency of a Supplier or Us

If any supplier becomes insolvent, we will make reasonable efforts to obtain refunds or alternate arrangements.
In the unlikely event of our insolvency, applicable consumer protection laws shall govern.

15. Behaviour, Safety & Right to Refuse

We reserve the right to refuse or cancel services for any guest whose behaviour endangers staff, property, or other guests.
No refunds will be given for termination due to misconduct or safety violations.

16. Baggage, Personal Effects & Valuables

Clients are responsible for their belongings.
Experience My India is not liable for lost or damaged items unless caused by proven negligence.

17. Special Requests & Accessibility

Special requests such as dietary needs, room preferences, or mobility assistance must be made at booking.
We will forward requests to suppliers but cannot guarantee fulfilment unless confirmed in writing.

18. Children & Infants

Parents or guardians are solely responsible for their children during travel.
Child discounts depend on age and supplier policies.

19. Groups & Events

Group bookings are governed by separate terms, including distinct payment and cancellation timelines.

20. Promotional Offers, Vouchers & Pricing

All quotations shared by Experience My India are final and already inclusive of all eligible discounts and promotions.
No additional discounts or reductions shall be applicable once a quotation is confirmed, even if market prices fluctuate later.

21. Intellectual Property

All itineraries, brochures, images, and website materials are the property of Experience My India.
They may not be copied or used without written permission.

22. Data Protection & Privacy

We collect personal information solely to manage bookings and comply with regulations.
Data is shared only with relevant suppliers and authorities where necessary.
You can request correction or deletion of your data in accordance with applicable laws.

23. Complaints Procedure

If an issue arises during travel, notify the supplier or our representative immediately.
If unresolved, a written complaint must be submitted within 28 days of the tour’s completion.
We will address complaints promptly and fairly.

24. Refunds

Refunds, if applicable, will be processed only for services not utilized, after deducting non-refundable supplier charges.
Refunds are not applicable for voluntarily skipped activities or services.

25. Insurance & Health Waivers

Clients must arrange their own travel or medical insurance as per personal preference.
Experience My India will not bear costs of illness, injury, or loss incurred during travel.

26. Indemnity & Client Responsibilities

Clients agree to indemnify Experience My India from claims, damages, or losses resulting from their negligence, behaviour, or violation of these T&Cs.

27. Severability & Waiver

If any provision of these Terms is found invalid by a competent court, the remaining clauses remain enforceable.
Failure to enforce any provision shall not constitute a waiver.

28. Notices & Communications

All official communication must be made in writing via registered email or post.
Notices sent by email are deemed received once transmitted.

29. Governing Law & Dispute Resolution

These Terms & Conditions are governed by the laws of India.
Any dispute arising from these T&Cs shall first attempt to be settled amicably.
If unresolved, disputes shall fall under the exclusive jurisdiction of the courts in Mathura, Uttar Pradesh.

30. Consumer Protection

Nothing in these Terms affects your statutory consumer rights under Indian law.

31. Public Health & Safety

Travellers must comply with all prevailing public health protocols, including vaccination, hygiene, and safety advisories issued by authorities or suppliers.

32. Electronic Contracts & Communication

Electronic booking confirmations, receipts, and acknowledgments hold the same legal validity as signed physical documents.

33. Optional Extras & Add-ons

Optional excursions or upgrades are subject to supplier availability and may carry separate terms.
Any cancellation of such add-ons will follow the supplier’s rules.

34. Remedies & Limitation Periods

Any claim against the Company must be made in writing within 28 days of the end of the tour.
Legal proceedings must be initiated within the period prescribed by applicable law.
(This clause is retained to protect both parties and ensure fair limitation of liability.)

35. Financial Security

We maintain transparent financial practices and comply with applicable GST, accounting, and consumer protection regulations.

36. Updates to Terms

Experience My India reserves the right to amend these Terms from time to time for legal or operational reasons.
The latest version will always be available on our website.

37. Acknowledgment & Acceptance

By proceeding with a booking, you acknowledge that you have read, understood, and accepted these Terms & Conditions, and that you are authorized to accept them on behalf of all travellers listed on your booking.

Terms of Service

1. Introduction

Welcome to Experience My India. By accessing and using our website and services, you agree to comply with and be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.

2. Use of Service

2.1 You must be at least [minimum age, typically 13 or 18] years old to use our services.

2.2 You agree to use our services only for lawful purposes and in accordance with all applicable laws and regulations.

2.3 You agree not to use our services to:

  • Distribute any content that infringes the intellectual property rights of others.
  • Distribute malicious software, viruses, or any other harmful code.

3. Accounts

4. Intellectual Property

4.1 All content on our services, including text, graphics, logos, images, and software, is the property of Experience My india or our content suppliers and is protected by applicable copyright and trademark laws.

5. Rights and Responsibilities

5.1 We reserve the right to modify, suspend, or discontinue our services (or any part of our services) at any time without notice.

5.2 We are not liable for any loss or damage arising from your use of our services or from any changes, suspension, or discontinuation of our services.

6. Termination

6.1 We reserve the right to terminate or suspend your account and access to our services at any time, without prior notice, if you violate these Terms of Service or for any other reason.

7. Limitation of Liability

7.1 To the maximum extent permitted by law, [Company/Service Name] shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or other damages arising from your use of or inability to use our services.

8. General Terms

8.3 Our failure to enforce any right or provision in these Terms of Service will not constitute a waiver of such right or provision.

General Terms

Experience My India operates as a tour package company. We provide curated travel packages, itineraries, and experiences for individuals and groups.
In addition to tour packages, we may assist in flight bookings, railway reservations, bus tickets, or other ticketing services. These services are considered separate from our tour packages and follow the terms of the respective third-party providers.
All bookings made with Experience My India are subject to availability and confirmation at the time of booking.
Prices quoted are dynamic and may vary depending on availability, seasonal factors, and vendor policies.


Payment Policy

To confirm your booking, a deposit or full payment (as specified at the time of booking) must be made.
Final payment must be received before the start of the tour. Failure to complete payment may result in cancellation of the booking without refund.
All payments must be made via approved payment methods (bank transfer, credit/debit cards, UPI, or other modes specified by us).


Inclusions and Exclusions

Inclusions in your package will be clearly mentioned in the itinerary shared with you (e.g., accommodation, meals, transport, activities).
Any service not specifically mentioned as included is considered an exclusion. Personal expenses, additional meals, and optional activities are not included unless stated.


Third-Party Bookings (Flights, Railway, Bus, and Tickets)

Experience My India may assist customers in booking flight tickets, railway reservations, bus tickets, and other third-party services as a value-added facility.
These bookings are made under the terms and conditions of the respective service provider (airline, railway, bus operator, etc.).
In case of last-minute changes, cancellations, price hikes, or operational issues by the third-party provider, Experience My India shall not be held liable.
Any extra cost arising from fare increases or cancellations will be borne by the customer.
Refunds (if any) received from the service provider will be passed on to the customer after deducting operational charges.


5. Cancellation & Refund Policy

All cancellations must be requested by emailing us at [Your Official Email ID] with your Trip ID, booking reference, and relevant details.
Cancellation charges vary depending on the time of cancellation before departure and the nature of services booked. The exact policy will be shared at the time of booking.
In the case of tour package cancellations, refunds (if applicable) will be processed after deducting cancellation charges, operational costs, and vendor penalties.
If any flight, railway, or other transport booked through us gets cancelled and the customer decides to cancel the entire tour package, then:

  • Cancellation charges applicable for the tour package will still apply separately.
  • Refunds for third-party services (airline, railway, etc.) will follow their respective policies.
    Refunds will be processed within 7–14 business days of receiving confirmation from the service provider.

Changes in Itinerary

Experience My India reserves the right to alter or modify itineraries due to unforeseen circumstances such as weather conditions, strikes, natural disasters, government restrictions, or other events beyond our control.
In such cases, we will make reasonable efforts to provide alternative arrangements of similar value.


Customer Responsibility

Customers must carry valid identification, travel documents, and permits as required.
Customers are responsible for adhering to local laws, customs regulations, and safety guidelines during the trip.
Any damages caused by the customer to property, vehicles, or hotels will be charged directly to the customer.


Liability

Experience My India acts as an intermediary between customers and third-party service providers (airlines, railways, hotels, transport operators, etc.).
We are not responsible for delays, cancellations, accidents, losses, or damages arising from services rendered by third parties.
Our liability is limited to the amount paid to us for the specific service in question.


Health and Safety

Customers must ensure they are medically fit to travel. Any health issues must be disclosed at the time of booking.
We are not responsible for medical expenses, accidents, or injuries incurred during the trip. Customers are advised to carry travel insurance.


Governing Law

These Terms & Conditions are governed by the laws of India.

By booking any service with Experience My India, the guest confirms that they have carefully read, understood, and agreed to all the above Terms and Conditions.
